Terms of Service

These Terms constitute a legally binding agreement between you and Muxen ("Muxen," "we," "us," or "our"). By creating an account or otherwise using the platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

You must be at least 13 years old to use Muxen. If you are between 13 and 18, you may only use Muxen with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using Muxen, you represent that you meet these age requirements. We do not knowingly permit children under 13 to register.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete information when registering.
• Keep your profile information truthful and up to date.
• Notify us immediately at support@muxen.app if you suspect unauthorized access to your account.
• Not share your account with or transfer it to anyone else.

You agree not to:

• Use Muxen for any unlawful purpose or in violation of any applicable law.
• Impersonate any person or entity, or misrepresent your affiliation with any brand, company, or creator.
• Post false, misleading, or fraudulent information about your audience size, engagement rates, or social account metrics.
• Harass, abuse, threaten, or intimidate other users.
• Transmit spam, unsolicited promotions, or phishing content.
• Attempt to scrape, crawl, or extract data from Muxen in an automated fashion without our written consent.
• Interfere with or disrupt the platform's infrastructure or security.
• Upload or transmit viruses or malicious code.

Creators on Muxen are responsible for ensuring that any social account metrics or audience data displayed on their profile are accurate to the best of their knowledge. Muxen pulls data directly from official platform APIs, but you are responsible for connecting the correct accounts. Misrepresenting your reach or credentials to attract brand deals may result in immediate account termination.

Muxen facilitates introductions and communications between creators and brands. Any deal, contract, payment, or partnership negotiated through or initiated on Muxen is solely between the creator and the brand. Muxen is not a party to those agreements and is not responsible for their execution, payment, or outcome. You release Muxen from any claims arising from disputes between creators and brands.

By connecting a social account (YouTube, Instagram, TikTok, Facebook, LinkedIn), you authorize Muxen to access publicly available data from that account via the platform's official API. Your use of connected accounts remains subject to the terms of service of each respective platform. You may disconnect any social account at any time through your Muxen account settings.

You retain ownership of any content you submit to Muxen (profile information, messages, media). By submitting content, you grant Muxen a non-exclusive, worldwide, royalty-free license to display and distribute that content solely for the purpose of operating the platform and providing the service to you and other users.

You represent that you have all necessary rights to the content you submit and that it does not infringe any third-party intellectual property, privacy, or other rights.

All rights, title, and interest in and to the Muxen platform — including its design, software, trademarks, and logos — are owned by Muxen. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding without prior written permission.

We may suspend or terminate your account at our discretion if we believe you have violated these Terms or engaged in conduct harmful to other users or the platform. You may delete your account at any time through your account settings. Upon termination, your right to use Muxen ceases immediately, though provisions that by their nature should survive (including limitation of liability and dispute resolution) will remain in effect.

THE MUXEN PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUXEN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO MUXEN IN THE 12 MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the United States. Any dispute arising from these Terms or your use of Muxen shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may modify these Terms at any time. When we make material changes, we will notify you via email or an in-app notice and update the "Last updated" date above. Your continued use of Muxen after changes take effect constitutes your acceptance of the revised Terms.
